Rental terms for Walterivo Co. services.
These Terms & Conditions govern dumpster rental services provided by Walterivo Co. Placing an order constitutes acceptance of these terms.
Rental Period
Each quote states the included rental period. Extensions are available at the published daily rate. Containers not released for pickup after the rental period may accrue additional daily charges.
Pricing And Weight Allowances
Quoted rates are flat rates that include delivery, the rental period, pickup, disposal and a stated tonnage allowance. Material exceeding the allowance is billed at the per-ton overage rate disclosed at booking. Clean-load pricing for concrete, dirt, brick and asphalt requires that the container contain only that material.
Prohibited Materials
Customers may not place hazardous or regulated materials in a container, including paint, solvents, motor oil, fuel, pesticides, pool chemicals, asbestos-containing material, medical waste, batteries, tires, refrigerant-charged appliances, propane tanks or electronic waste. Customers are responsible for all costs, fines and remediation resulting from prohibited materials, including rejected loads and facility surcharges.
Loading Limits
Material may not extend above the top rail of the container. Overloaded containers cannot be legally transported; the customer must remove excess material before pickup, and a dry-run fee may apply if the driver cannot complete the haul.
Site Access And Property
The customer is responsible for ensuring safe, legal and unobstructed access to the placement location, including adequate overhead clearance and surface capacity. While Walterivo Co. uses protective boards on residential deliveries, the customer accepts that placement of heavy equipment on driveways, pavement, lawns and private surfaces carries inherent risk. Walterivo Co. is not liable for damage to underground utilities, irrigation, septic components, decorative surfaces or unmarked private improvements.
Permits
Where a container will occupy a public street, sidewalk or right-of-way, the customer or property owner is responsible for obtaining and maintaining the required municipal permit.
Cancellations And Dry Runs
Orders cancelled before dispatch are not charged. If a truck arrives and cannot deliver or retrieve a container due to obstruction, denied access or an overloaded box, a dry-run fee applies.
Payment
Payment is due per the terms stated on the quote or invoice. Approved commercial accounts may be invoiced on agreed terms. Past-due balances may accrue interest as permitted by California law.
Limitation Of Liability
Walterivo Co.'s liability for any claim arising from a rental is limited to the amount paid for that rental. Walterivo Co. is not liable for indirect, incidental or consequential damages including project delays or lost profits.
Governing Law
These terms are governed by the laws of the State of California, with venue in Los Angeles County.
